Dubuque, IA – April 8, 2026 — Cody James Hillery, 36, was arrested Wednesday morning on a charge of second-degree criminal mischief, a class “D” felony.

Hillery, was taken into custody at approximately 7:30 a.m. at the Dubuque Law Enforcement Center, 770 Iowa St. The arrest was made by Officer M.J. Bahl.

The charge stems from alleged property damage estimated between $1,500 and $10,000, in violation of Iowa Code §716.4. A class “D” felony carries a maximum penalty of up to five years in prison and a fine of $1,025 to $10,245, plus possible restitution, probation, or other conditions.

Limited public information is available about the specific events. The arrest occurred at the law enforcement center, which houses the Dubuque Police Department, County Sheriff’s Office, and jail. No details on the damaged property, victims, or exact circumstances have been released.

Iowa law classifies criminal mischief by damage amount:

•  First degree: Over $10,000 (class “C” felony)

•  Second degree: $1,500–$10,000 (class “D” felony)

•  Lower amounts typically result in misdemeanors

Legal Process

Hillery is presumed innocent until proven guilty. He will appear before a magistrate for an initial hearing, where bond and plea options will be addressed. The Dubuque County Attorney’s Office will review evidence, including damage assessments and witness statements. Many such cases resolve through plea agreements, potentially reducing the charge upon restitution.
