The new law, “An Act Relating to the Safety of Persons in Certain Professions Involved with the Judicial System,” authorizes eligible officials—including legislators, judges, the Attorney General, and deputy/assistant attorneys general—to obtain a professional concealed carry permit after completing required background checks and training.
Key Provisions
• New Criminal Offenses: Creates penalties for threatening protected officials or their immediate families and for maliciously sharing (doxxing) their private personal information, such as home addresses or children’s school locations, with intent to harm or intimidate.
• True Threats: Explicitly treats qualifying “true threats” against these officials as harassment, subject to prosecution while preserving First Amendment protections through intent and context requirements.
• Penalties: Range from fines and misdemeanors to felony charges with prison time for aggravated cases. Victims can also seek expedited civil remedies.
The measure responds to a documented rise in threats, harassment, and doxxing against judicial and legislative figures. Supporters say it protects public servants from intimidation without shielding them from legitimate criticism. Opponents raised First Amendment concerns, leading to amendments that include exceptions for public records, journalism, and good-faith speech.
The law takes effect in phases, with criminal provisions activating in about 90 days and the permitting system launching within six months. State agencies will oversee implementation and conduct a one-year effectiveness review.
Judicial and law enforcement groups welcomed the bill, while civil liberties organizations pledged to monitor its enforcement. The legislation reflects a growing national effort to safeguard officials amid increasing polarization.
