DUBUQUE, Iowa — A 43-year-old Dubuque resident faces serious felony charges following an early morning arrest on February 10, 2026, involving allegations of forcible sexual abuse and burglary at a local residence.

According to arrest information, Justin Clifford Nank 43, was taken into custody at approximately 9:09 a.m. at or near 881 Berkley Place in Dubuque. He has been charged with:

1.  Sexual Abuse in the Third Degree – Forcible Fondling (Class C felony)

2.  Burglary in the First Degree – Burglary/Breaking and Entering (Class B felony)

The charges stem from an incident that authorities have not yet publicly detailed in full. Under Iowa law, third-degree sexual abuse (Iowa Code § 709.4) generally involves non-consensual sexual contact—such as forcible fondling of intimate body parts—where the perpetrator uses or threatens force that creates a substantial risk of bodily injury, or where the victim is physically helpless or otherwise unable to consent. Conviction on this count carries a potential prison sentence of up to 10 years.

First-degree burglary (Iowa Code § 713.3) is a more severe offense, typically requiring unlawful entry into a dwelling (or remaining unlawfully therein) with the intent to commit a felony—here, presumably the alleged sexual abuse—while another person not involved in the crime is present in the dwelling. The “breaking and entering” specification indicates that force, deception, or unauthorized entry was allegedly used. If convicted, first-degree burglary can result in a prison term of up to 25 years, with additional consequences including mandatory minimum sentencing in some scenarios and lifelong sex offender registration.
