
Dubuque, IA – A local man Ryan Luetelschwab faced charges for eluding law enforcement at speeds over 25 miles per hour above the limit, an incident that occurred on August 27, 2023. The case, presided over by Dubuque County District Court Judge Thomas A. Bitter, concluded with a deferred judgment on October 7, 2024.
The individual, identified was initially charged with a Class D felony under Iowa Code 321.279(2)(a). The charge stemmed from an attempt to evade law enforcement, significantly exceeding the speed limit. Luetelschwab was clocked going 122 mph.
During the adjudication process, the charge was deferred, allowing the defendant an opportunity to avoid a formal conviction. Judge Bitter handed down the deferred judgment, along with a 24-month probation period. The probation is categorized as “other than DCS,” indicating it does not fall under the Department of Correctional Services.
In addition to probation, the defendant was assessed a civil penalty. No additional fines, restitution, or drug-related penalties were imposed. The judgment also did not include any provisions for extradition, license revocation, or batterer intervention programs.
